2.1. These Terms apply to the Device identified above. They govern your use of the Device and your licence to use the Firmware.
2.2. You accept these Terms by purchasing and/or using the Device. Where you are a Consumer, your mandatory statutory rights apply regardless of acceptance and are not limited by these Terms.
2.3. These Terms do not cover the sale of the Device itself. The contract of sale, including price, delivery, invoicing, and any right of withdrawal, is between you and the Authorised Seller from whom you purchased the Device; see Sections 10.4 and 10.5.
2.4. Each product manufactured by APRIMS is or will be accompanied by its own terms; these Terms apply only to the Device defined in Section 1. These Terms do not apply to products of other manufacturers that APRIMS distributes or resells; such products are covered by the terms of their respective manufacturers.
3. Description of the Device
3.1. The Device is a compact Wi-Fi smart relay with a potential-free (dry-contact) output, designed to be installed in a standard switch box or junction box and to work with Apple Home.
3.2. APRIMS is the manufacturer of the Device. The Firmware is developed by APRIMS, and the Device is built on hardware assembled by Shelly Europe Ltd. (“Build on Shelly”), with manufacturing completed by APRIMS. The Device has been certified by APRIMS to meet Apple performance standards for use with Apple Home and carries the “Works with Apple Home” badge. It is a distinct product and does not operate on, and does not support, any third-party smart-home platform other than Apple Home.
3.3. Operating on its own, the Device switches an electrical load or provides a dry-contact signal to a third-party unit, and can be controlled locally by a connected switch or button. Smart functionality – including control from the Apple Home app, voice control, remote access and automations – depends on the Apple Home ecosystem and on compatible Apple devices, software and services; see Sections 4 and 8.
3.4. The output terminals are not internally connected to any voltage potential (dry contact) and may be used to control a device that provides an external control input. Such a controlled device operates on its own independent circuit.
4. Compatibility requirements
4.1. The Device connects over Wi-Fi (802.11 b/g/n, 2.4 GHz). It does not support Thread or Matter. A working Wi-Fi network and internet access are required for setup and for firmware updates.
4.2. To control this HomeKit-enabled accessory, the latest version of iOS or iPadOS is recommended. An Apple Account is required to use the Apple Home app.
4.3. Controlling this HomeKit-enabled accessory automatically and away from home requires a HomePod, HomePod mini, or Apple TV set up as a home hub. It is recommended that you update to the latest software and operating system.
4.4. Availability of Apple devices, software, services and features, and the requirements to use them, are determined by Apple and may change. See Section 8.
5. Safety and installation
Read this section and the user manual before installing or using the Device. Failure to follow the installation and safety requirements may cause malfunction, property damage, injury or death, may breach applicable law, and affects the allocation of liability set out in Section 12.
5.1. Qualified installation only. The Device connects to mains or low-voltage electrical circuits and has exposed screw terminals for connection to the electrical supply and to the controlled load. It presents a real risk of electric shock. Installation and connection to the electrical supply must be carried out only by a qualified electrician (or a suitably qualified and authorised electrical installer), in accordance with the wiring diagrams and instructions in the user manual and with all applicable standards, safety norms and regulations. Before working on the wiring, the installer must switch off the relevant circuit breaker and verify that the terminals are free of voltage.
5.2. Circuit protection. The Device and the appliances connected to it must be protected in accordance with EN 60898-1 (tripping characteristic B or C, max. 16 A rated current, min. 6 kA interrupting rating, energy limiting class 3). Do not connect the Device to appliances that exceed the maximum permitted electrical load. Connect the Device only in the manner shown in the user manual.
5.3. Load type and switching limitations. The Device switches loads through an electromechanical relay with a compact contact system, in which the contact separation is reduced (a “micro-gap”) as a result of the Device’s miniaturised construction. This contact gap is adequate for the mains voltage and reliably makes and breaks resistive (active) loads up to the Device’s rated current, and is suitable for operative (control) circuits. A reduced contact gap has, however, a limited ability to extinguish the electric arc produced when switching off inductive (reactive) loads. Accordingly, the Device is intended for resistive (active) loads and operative circuits at its rated current; its use with inductive or reactive loads is limited and is suitable only for small, low-power appliances, within the lower ratings stated in the user manual and product specification. Do not use the Device to switch inductive or reactive loads beyond those ratings. Switching loads outside the Device’s specification may cause arcing, contact welding, overheating, damage or fire.
5.4. Electrical grid conditions. Although the Device includes protections such as overvoltage protection and internal thermal protection, as a device connected to the electrical grid it is exposed to abnormal grid conditions that are outside the Device control, including atmospheric and switching overvoltages, surges, and transients arising from short circuits or other abnormal conditions of the grid. Such conditions may damage the Device or connected equipment.
5.5. Not a safety or security system. The Device is not a life-safety, life-support, or security system and must not be relied upon as one. Do not use the Device in any application where its failure, malfunction, or delayed or incorrect operation could lead to death, personal injury, or severe physical or environmental damage. Automations that operate physical loads are used at your own risk; you are responsible for ensuring that any automation is safe for the connected load and environment.
5.6. General. The Device is for indoor use only. Keep it away from moisture, dirt and heat sources. It is not a toy; keep it out of the reach of children. Do not attempt to repair or modify the Device. If the Device shows any sign of damage or malfunction, stop using it and replace it. Repairs must be carried out only by authorised personnel.
5.7. Intended for adults; keep away from children. The Device is intended for purchase, installation and use by adults. Installation and any work on the electrical connection must be carried out only by a qualified electrician (see Section 5.1). The Device is not a toy and is not intended for use or handling by children; keep the Device, and any switch or button connected to it, out of the reach of children. If you allow a child to use or handle any control connected to the Device, you are responsible for their safe use of it in accordance with these Terms and the user manual.
6. Firmware licence
6.1. The Firmware is licensed, not sold, to you. Subject to these Terms, APRIMS grants you a limited, non-exclusive, non-transferable, revocable licence to use the Firmware solely as embedded in, and for the normal operation of, the Device you own or control.
6.2. You may not, and may not permit others to: copy, modify, adapt, translate, or create derivative works of the Firmware; reverse engineer, decompile, or disassemble the Firmware, or attempt to derive its source code, except to the extent that such restriction is prohibited by applicable law; or remove, obscure or alter any proprietary notices in the Firmware.
6.3. The Firmware developed by APRIMS is the property of APRIMS. The Device and its Firmware also incorporate hardware and software components owned by third parties, and may include open-source software components, which are licensed separately under their own terms. Nothing in these Terms grants you any rights in such third-party or open-source components beyond the rights granted under their respective licences.
6.4. No fee after purchase. No fee is or will be charged by APRIMS to you for accessing or using the Apple Home functionality of the Device after the point of sale.
6.5. The licence granted in this Section transfers with ownership of the Device to a subsequent owner, provided that owner agrees to these Terms; you must not retain any copy of the Firmware separate from the Device.
7. Firmware updates
7.1. Firmware updates are delivered as an automatic process. When the Device is connected to the internet over Wi-Fi, it checks for a new version shortly after a power cycle and, if a new version is available, may download and install it automatically. Please do not switch off the Device during an update.
7.2. The check for updates is a one-way outbound request from the Device to a passive file server operated by APRIMS, over a secure HTTPS/TLS connection. The server does not collect or log personal data from you or your Device. See Section 9.
7.3. APRIMS commits to provide:
- Security updates for the Firmware for a period of seven (7) years from the date the Device is first placed on the market by APRIMS; and
- Functional and maintenance updates for the Firmware, as needed, for a period of five (5) years from the same date, at APRIMS’ discretion and to the extent technically feasible. Such updates are primarily intended to maintain the Device’s operation – for example, to support changes in the communication protocol or the Wi-Fi stack – rather than to add new features.
7.4. The commitments in Section 7.3 are subject to the continued availability and operation of the third-party ecosystems on which the Device depends, including the Apple Home ecosystem and the underlying hardware/chip platform. If a third party changes, withdraws, or discontinues functionality, technology or services that are essential to the Device, and this is outside our control, the scope of updates we can provide may be affected. This does not reduce your statutory rights; see Sections 10 and 12.
7.5. The availability of updates may vary by region and over time.
8. Apple Home and third-party services
8.1. Apple is not a party to these Terms. These Terms are between you and APRIMS only. Nothing in the Device, its packaging, its documentation or these Terms indicates any sponsorship, partnership, or endorsement by Apple.
8.2. The Device is designed to work with Apple Home. Smart functionality – including control via the Apple Home app, control by asking Siri, remote access and automations – requires compatible Apple devices, operating systems, an Apple Account, and the Apple Home ecosystem, and is subject to Apple’s own terms and to Apple’s privacy policy. Availability and operation of these Apple products and services are determined by Apple and are outside our control.
8.3. HomeKit technology provides advanced security with end-to-end encryption and authentication between a HomeKit-enabled accessory and your iPhone, iPad, Apple Watch, HomePod, HomePod mini, or Mac.
8.4. Use of the Works with Apple badge means that an accessory has been designed to work specifically with the technology identified in the badge and has been certified by the developer to meet Apple performance standards. Apple is not responsible for the operation of this device or its compliance with safety and regulatory standards.
9. Data and privacy
9.1. The Device is designed to operate within the Apple Home ecosystem. APRIMS does not operate any cloud service, account system, portal or API for the Device, and does not collect, store, access or retain your personal data or your Device’s operational or usage data.
9.2. Operational and usage data generated by the Device (such as switch state, configuration, and the times and types of switching events) is processed and, where applicable, may be stored within the Apple Home ecosystem – for example on your Apple Home hubs and, if enabled, in your iCloud account – under your control and subject to your Apple Account and iCloud settings and to Apple’s privacy policy. To the extent that any such data constitutes personal data, APRIMS is not the controller of that data; it is handled within the Apple ecosystem under your control.
9.3. The only communication between the Device and APRIMS is the outbound firmware-update check described in Section 7.2. This check does not transmit personal data to APRIMS, and APRIMS does not collect, log, or have access to your IP address or any other personal data in connection with it. APRIMS does not make any inbound connection to your Device or network.
9.4. Further pre-contractual information about the data the Device can generate, its format, and how you may access, retrieve or erase it – provided in accordance with the Data Act (Regulation (EU) 2023/2854) – is available on the product page at https://aprims.com/relaytswitch.
10. Warranty
10.1. Your statutory rights come first. As a Consumer, you benefit from a legal guarantee of conformity and other rights under the consumer-protection law applicable to you. These rights are provided against the seller and, where applicable, the producer, and cannot be excluded or limited by these Terms. Depending on the defect and subject to the conditions of the applicable law, your statutory remedies may include repair, replacement, a proportionate price reduction, or termination of the contract, as provided under the consumer law applicable to you. The commercial warranty in Section 10.2 is in addition to, and does not replace or reduce, those statutory rights. For products with digital elements, the legal guarantee includes the supply of updates necessary to keep the Device in conformity for the period you may reasonably expect (see Section 7).
10.2. APRIMS commercial warranty. In addition to your statutory rights, APRIMS provides a commercial warranty that the Device is free from defects in materials and workmanship, when installed and used in accordance with the user manual and these Terms, for a period of twenty-four (24) months from the date of original purchase. Under this warranty, APRIMS will, at its option and free of charge, repair the Device, replace it, or refund the price paid, in respect of a valid warranty claim.
10.3. The commercial warranty does not cover: normal wear and tear; cosmetic damage; damage or defects resulting from installation by a person who is not a qualified electrician, or from failure to follow the user manual and the safety and installation requirements in Section 5; use outside the Device’s specification, including switching of reactive (inductive or capacitive) loads beyond the lower ratings referred to in Section 5.3; damage caused by abnormal conditions of the electrical network (Section 5.4); accident, misuse, liquid, fire, or other external cause; or any modification, repair or opening of the Device by anyone other than APRIMS or a person authorised by APRIMS. This Section 10.3 does not affect your statutory rights.
10.4. In case of a warranty claim, you may return the Device to the Authorised Seller from whom you purchased it:
- if you purchased from a distributor or retail seller, return it to that seller;
- if you purchased directly from APRIMS, return it to APRIMS;
- if you purchased through a marketplace (e.g. Amazon), follow that marketplace’s return process; after any applicable withdrawal period, claims are handled with the seller from whom you purchased the Device on that marketplace.
10.5. Right of withdrawal. Any right to withdraw from the purchase – for example, a 14-day right of withdrawal for distance sales to Consumers – is provided and handled by the seller from whom you bought the Device, under that seller’s terms and applicable law. Where you buy from a distributor, retail seller or marketplace, that seller is responsible for withdrawal and returns. Where you buy directly from APRIMS, APRIMS is the seller and handles withdrawal and returns.
11. Disclaimer of implied warranties
11.1. Subject to Section 10.1 and to your statutory rights, and to the maximum extent permitted by applicable law, the Firmware and any functionality provided through the Apple Home ecosystem are provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied or statutory, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement.
11.2. APRIMS does not warrant that the Firmware or any Apple Home functionality will meet your requirements, that operation will be uninterrupted or error-free, or that the Device will remain compatible with future versions of third-party software, services or ecosystems.
11.3. Nothing in this Section limits or excludes any warranty, right or remedy that cannot be limited or excluded under applicable law, including a Consumer’s statutory rights.
12. Limitation of liability
12.1. Liability we do not exclude. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for: death or personal injury caused by our negligence; gross negligence or wilful misconduct; fraud or fraudulent misrepresentation; any liability under applicable product-liability law (including Directive (EU) 2024/2853 and its national implementations); and a Consumer’s mandatory statutory rights.
12.2. APRIMS remains responsible, in accordance with applicable law, for damage, including personal injury, caused by a defect in the Device for which APRIMS is liable.
12.3. To the maximum extent permitted by applicable law, and without affecting Sections 12.1 and 12.2, APRIMS is not liable for loss, damage or injury to the extent it is caused by the reasons described below, rather than by a defect in the Device for which APRIMS is responsible:
- (a) installation by a person who is not a qualified electrician, or failure to comply with the user manual or the safety and installation requirements in Section 5;
- (b) abnormal conditions of the electrical network (including atmospheric and switching overvoltages, surges, short circuits and other abnormal conditions) as described in Section 5.4;
- (c) modification of the Device, or use of the Device outside its specification or otherwise contrary to these Terms (including switching of reactive loads beyond the lower ratings referred to in Section 5.3).
12.4. To the maximum extent permitted by applicable law, APRIMS is not liable for any indirect, incidental, special or consequential loss or damage, including loss of profit, loss of revenue, loss of data, or business interruption, arising out of or relating to the Device, the Firmware, or any Apple Home functionality.
12.5. To the maximum extent permitted by applicable law, APRIMS is not liable for loss or damage arising from any act, change, suspension or discontinuation by a third party whose products, services or ecosystems the Device depends on (including Apple Home), where this is outside our control (see Section 7.4).
12.6. Section 14 sets out how liability applies to Business Customers.
13. Intellectual property
13.1. “APRIMS” and “Relayt Switch” are names and marks used by APRIMS. The Firmware and all intellectual property in it developed by APRIMS are and remain the property of APRIMS. All rights not expressly granted to you in these Terms are reserved.
13.2. The Device is built on hardware assembled by Shelly Europe Ltd. (“Build on Shelly”). “Shelly” is a trademark of Shelly Europe Ltd. Apple, Apple Home, Apple Watch, HomeKit, HomePod, HomePod mini, iPad, iPhone, Apple TV, Mac, Siri, and tvOS are trademarks of Apple Inc., registered in the U.S. and other countries and regions. All other trademarks are the property of their respective owners.
13.3. Apple trademarks are used in these Terms only to indicate that the Device works with Apple technology, and not to indicate any sponsorship, partnership or endorsement by Apple.
14. Business Customers
14.1. This Section applies where you acquire or use the Device as a Business Customer (that is, not as a Consumer). The consumer-protection provisions of these Terms, and mandatory consumer rights, do not apply to Business Customers.
14.2. As between APRIMS and a Business Customer, any warranty is limited to the commercial warranty in Section 10.2 and to any warranty expressly agreed in writing; all other warranties, conditions and terms implied by law are excluded to the maximum extent permitted by applicable law.
14.3. To the maximum extent permitted by applicable law, and without affecting Section 12.1, APRIMS’ total aggregate liability to a Business Customer arising out of or in connection with the Device, the Firmware, or these Terms shall not exceed the price paid for the Device, and APRIMS shall have no liability to a Business Customer for any indirect, incidental, special or consequential loss, including loss of profit, loss of revenue, loss of data, or business interruption.
14.4. Where APRIMS and a Business Customer have entered into a separate commercial agreement (for example, a distribution or reseller agreement), that agreement governs their commercial relationship – including the settlement of disputes between them – and prevails over these Terms in the event of any conflict.
15. Changes to these Terms
15.1. APRIMS may update these Terms from time to time. The current version is the version published on the product page at https://aprims.com/relaytswitch/termsandconditions.
15.2. For a Device already purchased, the version of these Terms that applies is the version in force at the time of your purchase. Changes do not apply retroactively to your detriment. This does not apply to changes that we are required to make to comply with a change in law, or that are necessary for safety or security reasons, which apply from the date they are published.
15.3. For new purchases, the version of these Terms published at the time of purchase applies.
15.4. Previous versions of these Terms are retained by APRIMS and are available on request; see Section 17.6.
16. Governing law and jurisdiction
16.1. These Terms are governed by the laws of Bulgaria.
16.2. If you are a Consumer, the choice of Bulgarian law in Section 16.1 does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you have your habitual residence, and does not deprive you of your right to bring proceedings in, or to be sued only in, the courts of that country, where such rights are available to you under applicable law.
16.3. The forum for the settlement of disputes between APRIMS and a Business Customer is as set out in any separate commercial agreement between them (see Section 14.4). In the absence of such an agreement, the competent courts in Bulgaria have jurisdiction.
16.4. If you are a Consumer in the United Kingdom, these Terms do not affect your statutory rights under UK consumer-protection law, including the Consumer Rights Act 2015, and nothing in these Terms limits or excludes any liability that cannot be limited or excluded under UK law.
16.5. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
17. Miscellaneous
17.1. If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
17.2. These Terms, together with the user manual and the Data Act information for the Device, constitute the entire terms governing your use of the Device and Firmware, and supersede any prior understandings on that subject matter, without limiting your statutory rights.
17.3. A failure or delay by APRIMS in enforcing any provision of these Terms is not a waiver of that provision.
17.4. These Terms are published in English, which is the governing version. Any translation is provided for convenience only. In the event of any discrepancy between the English version and a translation, the English version prevails, except where mandatory law applicable to a Consumer requires that the version in the Consumer’s language prevail.
17.5. At the end of its life, the Device must not be disposed of as unsorted household waste. Please dispose of it in accordance with local regulations for waste electrical and electronic equipment (WEEE).
17.6. For questions about the Device or these Terms, contact APRIMS at info@aprims.com. For questions or disputes about a purchase, a right of withdrawal, or a return, contact the Authorised Seller or marketplace from which you purchased the Device (see Section 10.4).
